Posted: 24 Dec 2015 08:31 AM PST You will not "hold out" for payment. You will be offered and only get what your car is worth, wholesale - not retail. If you owe money for the car, the bank gets paid first. If you owe more than the car is worth, you will still owe the bank the remainder. Many times, if you've financed the car, you will not see much, if any money. If your car was paid off, you'll get the wholesale (trade-in) value of the car. You will not get much, in most cases so you'll need to find your own money to add to what you get, to replace the vehicle. If you were at fault, you get the value minus your deductible. If the other party was at fault, (usually the case for rear-end collisions) and you had a luxury vehicle, you may only get part of the value because you may reach the limits of the other party's insurance, especially if they had sub-standard or minimum coverage. For medical bills, you only get the bills paid, until you reach the maximum limits of the insurance policy that is covering the bills. You will not get anything for "fixing up" the car, only what it would bring to a dealership, on a trade-in. You may be able to remove an improved radio, or other undamaged 'add-ons", before you turn it over to the insurance company for disposal. Engine mods, and most other 'improvements' are not things that are useful to be removed to attempt to recoup some of your 'investment'. You will not recoup time lost from work, or medical "pain and suffering", except via a lawyer. If you hire a lawyer, it will change the game significantly, and slow things down, since the insurance will stop the claim and process everything through the court / lawyer, who gets paid before you see a dime, and gets that largest piece of any settlement. |
