Question: Is taking insurance money & deciding not to fix your car insurance fraud? Posted: 23 Apr 2015 07:45 AM PDT Perfectly legal. Right before this incident your car was worth a certain amount of money. This incident reduced the value of your car. Your insurance must compensate you for the reduced value. You can either spend the money to repair the vehicle and restore its value to what it was worth before the incident, OR you can drive around in a dented car and spend the money elsewhere. Generally if the car is old & beat up anyway you might not care about one more dent or scratch, so you might as well keep the money. If its a nicer, newer car and this is the only scratch or dent, then its probably best to get it fixed. In that case you can ask the insurance company to pay the repair shop directly - that way if the repair shop finds hidden damage the insurance company is on the hook. If you accept the check directly from insurance the claim is closed and you cannot demand more money if you find hidden damage later. |
