Posted: 18 Aug 2016 08:16 AM PDT Who is the registered owner on the title of "your" car? If your mom is the sole title holder (meaning no other name is on it) or if the names on the title includes an "or", then the person holds the ownership to "your" car. On the other hand, if your mom is not the registered owner, or if the title has 2 registered owners and includes an "and" then your mom cannot sell the car without the proper signatures on the title and the new owner should not be able to transfer the title into their own name. If the title is not solely in your mom's name, or has an "and" between the registered owners name, then you can go to the DMV and explain your title was mistakenly given to someone and you need a new one, there will be a fee to apply for a replacement title. Here is the the biggest part of the whole deal: If the person who bought the car doesnt have the title, they dont own it. You/your mom still has the title. Which means you can "repossess" the car. Your best bet would be to go to the DMV with your mom and explain the situation. They cant give legal advice, but they can let you know what your options are through them. |
