Insurance is required by law in most of the civilized world. And in the few places where it's not required, it means you personally accept all financial obligations for any damage your vehicle causes. Getting caught driving without insurance is bad enough. Fines, suspensions, vehicle impoundment, and a surcharge added to your already outrageous insurance premiums (which you'll need to pay to get your vehicle out of the towing yard). Getting into an accident without insurance just adds to the agony. In addition to all the fun stuff mentioned above, you also get to pay for the entire accident yourself. That's not too bad if you trash a $300 beater, but with your luck (and you're not very lucky) you'll end up destroying a brand new BMW and the owner will sue you for soft tissue injuries. That means you'll be working a second job for free (they'll take your paycheque before you get it) for the next twenty years to pay it all off. |

Find a way to come up with your deductible. Once you do, then your insurance FIGHTS for you, to get back your deductible, plus what your insurance pays, since your insurance will be "invested" in this accident. When insurance investigates an accident, even though there is no police report, they still have to take a full statement from you, and from him on "how" this accident happened. They do compare the damages to each car to see if they "match" up, per how the accident happened. It is apparent that by both vehicles side damages, that (one) of you drove into the other, the question is who? Now, if they are denying your claim, that means they will be filing a claim on your policy for him, since they believe you are at fault vs him. |

You checked the DMV's own website, and found their answer right on the screen. Your friend says the DMV is wrong, and that he knows the real answer. Who, in your opinion, is the more reliable source? The girl who hit you isn't going to outright lie, not exactly, she's just going to paint a more innocent picture of herself. I've seen a hundred cases just like this, and here is exactly what this bimbo is going to say to 'dispute' her responsibility for the accident... "I got into my car and started it, checked really carefully and no one was coming so I backed up. No wait, before I backed up, I got out of the car, looked both ways, put up warning signs and lit road flares, then got back in and slowly started backing up very carefully. I had totally finished backing up, in fact I was just shifting into drive and stopped dead. Suddenly, this other vehicle comes fa-lying down the lane (she'll say it like that: fa-lying), way too fast to see me, way too fast for public safety in fact. He was doing at least 90, no kidding. He hit my stopped car, and it's a wonder I survived. He was talking on his cell phone, I think while getting a BJ, and probably drunk. So obviously it's his fault, right?" Okay she might not tell it as well as I did, but it will be close. And guess what, none of it will make a difference in any way. She tried to make herself look innocent, but she admitted that she was backing out of a parking space when it happened. Here's the deal: When your vehicle is backing up, you have no right of way over anyone at all. When you're leaving a parked position, you have no right of way over anyone at all. And she was doing both. Her statement will match yours and that of the witness, and her insurer (they can do this, it's in the contract) will accept 100% liability on her behalf. Because they've heard that story a million times before too. |
